Hi,
Being a newbie, I've read countless articles when exploring the process of protecting my work. Does someone have a simple and definitive answer please -
"How do I copyright my screenplay?"
I'm a UK writer and want to ensure I protect my work in case of any issues further down the line.
Thanks
Legally, as a UK resident, you have copyright by default as the content creator and that copyright is upheld by all member countries of the Berne Convention.
However, the USA is not a member of the Berne convention so it won't be legally upheld there... where most English speaking scripts are sold and made.
To add another issue, some unions and distributors require producers to supply what's called a chain of title that shows they've done their due diligence and have sourced a script coming from someone willing to put in writing that they are the content creator and have a recognised claim to copyright to back it up.
Therefore, it simply makes sense for all writers to register a claim with the US Library of Congress as this not only registers a claim with evidence, it satisfies the paper trail should a script get made.
Yep, US Copyright Office. It's the only guaranteed protection, worldwide.
As a former newbie but not pro yet, and a Canadian, I had to do a lot of research, reading, and talking to people. Many articles online are conflicting because the author is referring to their local copyright laws, but don't always make that clear.
I don't need a registered copyright number from the US Copyright office to submit or sell a script within Canada, However, if a producer wants to distribute outside of Canada, and I don't have a registered number from the US Copyright office, the whole deal could be cancelled, and I would be back to square one, with possibly a bad reputation. So, it just makes the most sense, even if no one gets distribution outside of Canada, to have a registered US Copyright on hand, for my screenwriting future.
If, however, and I really am trying to keep this answer simple, you just want to protect your work as you explore screenwriting, you're safe to upload scripts on this site, with or without a registered copyright, though a registered copyright is highly recommended. For any other site, or an individual who wants a script, I would advise caution. Read everything, including fine print. Ask questions, get to know people. Always keep in mind that you have every right to say no or simply decide to not upload a script. That's your protection.
